Regulation Authority:

Chapters 42-17.1, 42-17.6, 20-1-2, 20-1-4, 20-3-2 thru 20-3-6, 20-4 thru 20-10, and in accordance with 42-35-18(b)(5), of the Rhode Island General Laws of 1956, as amended.

Purpose and Reason:

The purpose of this filing is to keep the commecrial possession limit for the commercial black sea bass fishery at 400 pounds per vessel per calendar day superseding ERLID # 5985 filied on February 9, 2010 to be effective on 12:01 AM February 12, 2010. This action to keep the fishery open is being taken after receiving notification from NMFS announcing a revision, in the way of an increase, to the 2010 coastwide commercial quota whereby increasing the state quota and negating the need to close the commercial fishery at this time.
